Working with ARC Architecture and Sturt & Company, Chapman Lily Planning are pleased to have secured permission on appeal for 18 detached bungalows with associated parking and access, for a property in Somerset. The appeal against the non-determination by Somerset Council followed a very protracted consideration period by the Council. Commenting on the critical issue of viability, as well as design, the Inspector advised,
“……the appellant has produced the convincing evidence required to justify departing from the provisions of SSLP policy SS6 in respect of the requirement for the payment of financial contributions towards the costs of social and physical infrastructure. It follows that I do not consider that a planning obligation is necessary under the terms of the relevant tests for the development to be allowed to proceed. The proposed dwelling’s overall scale is diminutive, while it would have a modern vernacular stemming from its form and materiality. The proposal’s design would be unlike anything within the immediate nearby vicinity, but unashamedly so”.
