The update confirms that the Council “can register new planning applications for new homes, but without evidence of mitigation to demonstrate phosphorous neutrality we will have no option other than to refuse those planning applications for causing a significant adverse effect upon the River Avon”. The Council have confirmed that they are setting up Section 33 agreements that will allow mitigation credits to be purchased.
Giles Moir, Director at Chapman Lily Planning commented “the updated position statement from the Council is welcome news, the moratorium on new residential development is causing considerable commercial difficulties for the development sector and we look forward to the mitigation schemes and associated mechanisms being formally adopted”.
