Alan Davies (Associate Director) explains ‘The Land Use and Regeneration Bill is now enacted. There is a plethora of implications for applicants and developers. One of which I want in particular to highlight today is the need for the developer /applicant to serve a Commencement Notice on the Council.
For developments commencing on or after 26th December 2023, the applicant must submit to the Local Planning Authority a Commencement Notice. This is entirely different and separate to any requirements under the Community Infrastructure Levy or Building Regulations. If the commencement date changes, a further notice must be served on the Council with the revised commencement date. Failure to serve the Commencement Notice allows the Council to serve notice on the landowner and any other interested party, requiring this information to be given to them within 21 days. Failure to do so is a matter which can be brought to the magistrates courts for prosecution.
