Chapman Lily Planning always try to keep abreast of current best practice and forthcoming changes in the development industry. We hold regular inhouse continuing professional development events, often supported by external allied professionals. This month the team were delighted to welcome Dan Tapscott, who heads-up Rapleys Neighbourhood Matters Team to guide us through:

Whilst amenity considerations such as daylight and sunlight require careful professional judgement, the British Research Establishment [“BRE”] guidance helpfully provides some objectivity. We would stress that Dan is the real expert in this field, but nonetheless as planners we need to know how to harness these tools. Dan kindly explained how to assess potential impacts and the importance of having good survey information.
Dan explained how rights to light can also be acquired making refence to S.62 Law of Property Act 1925 and even the Prescription Act 1832! Issues such as party walls, access arrangements and boundary disputes are not uncommon, and it was also helpful to receive an update on these. Whilst not planning issues, such considerations are pertinent to our clients and as such its important that we are aware of them.
