Steve Tapscott, senior planner at Chapman Lily, recently participated in a webinar on how councils can exercise their duties under the 2020 coronavirus legislation. Commenting after the event, Steve said ‘councils are clearly facing unenviable challenges to make sure they keep providing services at this difficult time. Whilst the new legislation provides them with additional flexibility, it is nevertheless up to each individual council to set out its own protocols and make sure its own constitution and Statement of Community Involvement are up-to-date. If not, it could make decisions taken during this time susceptible to judicial review’.
As with any new legislation, it will take time for it to be interpreted, particularly through the courts. Chapman Lily Planning will continue to keep up-to-date with how the situation unfolds but we are already seeing planning Committees taken online.
